Juan C. Santos is a Senior Attorney in Chapman Law Group’s Miami office. He has a wealth of experience in representing clients under investigation by the Department of Justice, FBI, Office of the Inspector General (“OIG”), DEA, and the Office of the Attorney General Statewide Prosecutor and Medicaid Fraud Unit.
Mr Santos defends clients facing allegations of fraud and abuse, compliance counseling and the defense of civil, administrative, regulatory and criminal healthcare fraud, including internal/defense investigations, False Claims Act litigation, settlement negotiations, withholding of Medicaid/Medicare Payments; Overpayments; exclusion from participation in Medicare/Medicaid programs; licensure and certification, DEA registration, anti-kickback violations; medical necessity issues; Quit Tam investigations (whistleblower), and physician self-referral (Stark).
Mr Santos also focuses his practice on advising health care providers on health care regulatory compliance matters. Juan is responsible for handling specific regulatory/compliance/transactional matters for physicians, DME companies, pharmacies and facility clients. His experience includes Stark/Anti-kickback analysis, TJC/JCAHO, HIPAA, EMTALA, physician employment agreements, physician practice formation, hospital/physician integration and bylaw revisions, physician reimbursement issues, telemedicine for physicians, and physician ancillary services.
Juan has been a guest speaker at the Health Care Compliance Association’s Regional Conference for health care providers and insurance companies. Prior to joining the firm, Juan obtained a Master’s in Health Care Law from Loyola University of Chicago (the “Program”). The Program concentrates on the legal, regulatory, political, ethical and economic aspects of health care delivery in the United States.
While in the Program, Juan was hired to work at Northwestern Memorial Hospital, Office of The General Counsel. Juan drafted and reviewed business arrangements such as physician contracts, data warehouse agreements, record custodian agreements, organ and tissue procurement agreements, and patient consent forms.
Prior to that, Juan worked at a law firm in his hometown of San Juan, Puerto Rico serving a diversified sector of the healthcare industry, including medical groups, physician-owned companies, hospitals, and health maintenance organizations. Juan provided counseling and representation to clients in structuring complex transactions that complied with the local and federal statutes and regulations that may have an impact over their operations.
As an undergraduate attending Villanova University, Juan was selected to participate as an intern in the prestigious Villanova University Law School clinic. Juan served as an interpreter, interviewing clients who in their vast majority were Latin immigrants working under inhumane and illegal conditions.
After obtaining his bachelor’s degree, Juan returned to San Juan to attend law school and become a full-time practicing attorney. Juan’s vast knowledge in health care law allows him to handle virtually all issues facing the modern healthcare professional, which makes him a formidable advocate for his clients.
