I believe that we do that at Stivers Law. We provide services in the areas of estate planning and probate. Estate planning includes drafting Wills, Trusts, Powers of Attorney, or other “pre-death” documents for clients. The estate plans we prepare are not cookie cutter plans. Our estate planning clients are with us for life.
In fact, we end up doing the estate plans for their children. We are essentially the quarterback for our estate planning clients meaning that we take a holistic look at the client’s goals and make sure they have a plan that works in conjunction with their financial goals. We work with their CPA, their financial advisor, and their insurance agent to make sure we are all on the same page.
However, we also work with the client to make sure their legacy is preserved. Obviously, we want to make sure the traditional things like preserving their assets are taken care of, but we also want to make sure that the intangible things like their family history, their values and their traditions are passed down from generation to generation.
To us, creating an estate plan is more than just drafting documents. It is about creating a life-long relationship. Probate administration on the other hand occurs after a person has died. Often this is because the person only had a Will or had no plan in place. We handle all aspects of probate (except litigation), but we see three common scenarios: 1) this is the typical probate where someone passed away and had assets in Florida that needs to be transferred to their heirs and beneficiaries; 2) often the person was a resident of another state but had a second home or other assets in Florida.
A primary probate is done in their resident state and then we are hired to do a second, or ancillary probate, for their assets in Florida; and 3) we are often hired by personal injury firms to open an estate and get a Personal Representative appointed so that they can proceed with their lawsuit, such as a wrongful death case.
