Scott E. Damon is a Partner at Butler Pappas. Scott focuses his practice on commercial litigation, products liability and insurer bad faith litigation. He received a Bachelor of Arts from the University of North Carolina at Chapel Hill in 1990. He received his Juris Doctorate from Vanderbilt University School of Law in 1993.
Scott's litigation practice includes representing clients in contract disputes, products liability claims and recalls, environmental litigation, and toxic tort lawsuits. Scott also represents clients in intellectual property cases, fiduciary disputes, agency litigation, securities litigation, and a wide variety of other commercial disputes.
Scott is admitted to practice before all state courts in Florida, the United States District Court for the Middle and Southern Districts and the Eleventh and Eighth Circuit Courts of Appeal. Prior to joining Butler Pappas, Scott was a partner with a national law firm in Orlando, Florida where he focused on commercial litigation and was hiring partner for the firm.
Scott's commercial practice has included contract litigation in numerous industries, including resort development, timeshare, real estate, financing and lending, engineering, healthcare, automotive manufacturing, chemical manufacturing, mining, securities, insurance, entertainment, and shipping. Scott has represented clients in environmental litigation involving CERCLA, RCRA and state statutory and common law claims.
His environmental litigation has involved TCE, silica, hydrochloric acid, phosphoric acid, sulfuric acid, and multiple carcinogenic substances and fuel spills. Scott has represented clients in class actions involving environmental claims and toxic torts claiming health effects and property damage from industrial accidents and accident spills.
Scott's commercial litigation practice includes representing clients in intellectual property disputes involving I.P. asset purchases, trademark infringement claims, licensing disputes, and joint venture and partnership litigation. He has represented clients in 10b-5 claims and other securities issues.
Scott has practiced extensively in products liability litigation representing automotive manufacturers in strict liability and negligence claims for catastrophic injuries and deaths arising from vehicle rollovers and other crashes. He has represented automotive parts manufacturers in reporting and safety campaigns with NHTSA.
He has also assisted clients in evaluating and conducting recalls governed by the Food and Drug Administration and the Consumer Product Safety Commission. Scott has additionally represented clients in nursing contract disputes and nursing standard of care claims. He has served as national counsel for clients defending mass tort claims pending in multiple states.
He has represented clients in estate litigation challenging wills based on undue influence and lack of testamentary capacity. Scott has represented businesses in class action consumer litigation involving alleged fraud and statutory claims regarding advertising and contests. He has also represented companies in defending ADA Title III claims.
Scott has spoken at litigation and trial advocacy skills seminars for lawyers and to industry groups and conventions on trial practice and other legal topics in several states.
